1 2025:CGHC:48572 NAFR HIGH COURT OF CHHATTISGARH AT BILASPUR MCRC No. 7230 of 2025 • Raju Singh S/o Sultan Singh Aged About 42 Years R/o Village- Haripura, Police Station- Osiya, District- Jodhpur (Rajasthan) ... Applicant versus • State Of Chhattisgarh Through- Station House Officer, Police Station- Basantpur, District- Balrampur-Ramanujganj (C.G.) ... Respondent (Cause title is taken from Case Information System) For Applicant : Mr. Vikram Pratap, Advocate For Respondent/State : Ms. Vaishali Mahilong, Panel Lawyer Hon'ble Mr. Ramesh Sinha, Chief Justice Order on Board 22/09/2025 1. This is the first bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) for grant of regular bail to the applicant who has been arrested in connection with Crime No.107/2025 registered at Police Station- Basantpur, District-Balrampur-Ramanujganj (C.G.) for the offence punishable under Sections 15(C), 25 & 29 Narcotic Drugs & Psychotropic Substance Act. 2. Case of the prosecution, in brief, is that on 07-06-2025, when the Police person of Police Station Basantpur were on night patrolling received information that near RTO Barrier, one truck bearing VAISHALI LUCKY NAGARIA Digitally signed by VAISHALI LUCKY NAGARIA Date: 2025.09.24 10:46:08 +0530 2 Registration Number RJ- 19/GJ-7447 is parked by the driver of the said truck and the driver went away and the contraband Doda is load in the said truck, upon reaching the spot the police authorities as per the provision of NDPS act search the vehicle and found out that the total 90 bags of Doda weighing about 14 quintal 44 KG worth of Rs. 1,30,00,000/- from the said truck, upon which the police made seizure of the said truck and also the Doda and registered the offences as mentioned above against the owner and driver of the said truck. During the investigation, the present applicant has been arrested from the Jodhpur being the owner of the said truck. 3. Learned counsel for the applicant would submit that the applicant has been falsely implicated in this case and it is further argued by learned counsel for the applicant is that in compliance of this Court’s order dated 11.09.2025, the medical report of the present applicant has been submitted by the Chief Medical and Health Officer, Ramanujganj (C.G), whereby it transpires that applicant is suffering from kidney ailment and he needs prolonged treatments and regular follow-ups under a Nephrologist and he is in jail since 24.06.2025 and the conclusion of the trial may take quite long time. Accordingly, he prays for enlarging the applicant on regular bail. 4. Learned counsel appearing for the State/non-applicant would oppose the bail application and submit that the charge-sheet has been filed in the present case. So far as the merits of the case is concerned it has been argued by learned State counsel that the applicant along with other two co-accused were found transporting 14 quintal 44 kgs of Ganja and other co-accused persons are absconding as such, the applicant is not entitled to be released on bail. 5. I have heard learned counsel appearing for the parties and perused 3 the case diary. 6. Taking into consideration the facts and circumstances of the case, nature and gravity of offence, from perusal of the case diary, it transpires that the contraband article i.e. Ganja, which has been seized from the possession of the applicant is much above the commercial quantity and it cannot be a case of false implication and applicant was found transporting the contraband article and arrested with the same and no plausible explanation has been given for recovery of such a huge recovery of contraband article i.e.14 quintal 44 kgs of Ganja, this Court is of the view that the applicant is not entitled to be released on bail in this case. 7. Accordingly, the second bail application of the applicant- Raju Singh, involved in Crime No.107/2025 registered at Police Station- Basantpur, District-Balrampur-Ramanujganj (C.G.) for the offence punishable under Sections 15(C), 25 & 29 Narcotic Drugs & Psychotropic Substance Act, is rejected at this stage. 8. The jail authorities are directed to medically treat the applicant as per the jail manual. 9.
