Heard Mr. Kamlesh Prasad, learned counsel for the petitioner. Also heard Mr. Swajeet Ubeja, learned Panel Lawyer, appearing for respondents No. 1 to 3/State. 2. The present petition has been filed by the petitioner with the following prayer: “It is, therefore, most respectfully prayed that this Hon’ble Court may kindly be pleased to allow this petition and quash FIR No. 431 of 2023 registered by the Police Station Torwa, District Bilaspur Chhattisgarh, and Criminal Proceeding pending before the learned Upper District Judge First Fast Track Special Court Bilaspur, District Bilaspur Chhattisgarh in Special Criminal Case (POSCO Act) No. 120 of 2023 against the petitioner and the petitioner may be acquitted from aforesaid offence under Section 376 of the IPC, in the interest of justice.” 3. Learned counsel for the petitioner submits that the present petition has been filed seeking quashing of the FIR and the consequent criminal proceedings. However, since the learned trial Court has already 3 commenced recording of the prosecution evidence and the trial is at an advanced stage, he seeks permission to withdraw the present petition. 4. Learned State counsel has no objection. 5. In view of the submission made by the learned counsel for the petitioner, the present petition is dismissed as withdrawn.
