Order 11/11/2025
1. The petitioners have filed this bail application under Section 483 of BNSS in FIR No.378/2025 registered at Police Station Saipau District Dholpur for offence under Sections 191(2), 191(3), 121(1), 132, 109(1), 262, 329(4), 324(4) BNS, 2023 and Section 3 PDPP Act.
2. Heard learned counsel for the petitioners as well as learned Public Prosecutor and perused the material available on record.
3.
Learned counsel for the petitioners submits that the petitioners have falsely been implicated in this case. He further submits that allegation against the present petitioners is of obstructing the public servant while discharging official duties. He argued that all the petitioners are female and have been implicated on false and fabricated grounds. He again submits that the petitioners are behind the bars since 09.10.2025 without any criminal past. The trial of the case will take considerable time, therefore, no fruitful purpose would be served by keeping the
[2025:RJ-JP:45247] (3 of 3) [CRLMB-13809/2025] petitioners in further custody and the bail application of the petitioners may be allowed.
4. Learned Public Prosecutor has vehemently opposed the bail application.
5. On consideration of the rival submissions and material available on record and in the light of submission made by learned counsel for the petitioners especially the fact that all the petitioners are women and there is no criminal antecedent against them but without expressing any opinion on merits/demerits of the case, I am inclined to grant benefit of bail to the petitioners.
6. Consequently, the bail application under Section 483 B.N.S.S. is allowed and it is directed that the petitioners Smt. Pooja W/o Jitendra Singh, Smt. Viddha Devi W/o Omveer, Smt. Pooran Dei W/o Kirodi, Smt. Munni W/o Bhikamsingh, Smt. Anita W/o Surendra, Smt. Uma W/o Hemsingh, Smt. Rajeshwari W/o Banwari, Smt. Pinki W/o Dharmsingh, Smt. Neetu W/o Shyamsingh and Smt. Kiran Dei W/o Durgsingh, be released on bail provided each of them furnishes a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the learned trial court with the stipulation that they shall appear before that Court on all subsequent dates of hearing till conclusion of the trial.
