HON’BLE MR. JUSTICE WASIM SADIQ NARGAL, JUDGE
ORDER 06.08.2025
01. The instant contempt petition arises out of order/judgment passed by the learned Writ Court dated 21.05.2025 in OWP No. 730/2013 by virtue of which the writ petition preferred by the petitioners was disposed of, by directing the respondent Nos. 3 to 5 to initiate action in accordance with law and ensure that Kacharrai land of village Mawa Krora Tehsil Akhnoor, District Jammu is preserved and protected. The said respondents were further directed to proceed in the matter in accordance with law and pass orders after issuing notice to the effected parties and after affording them an opportunity of hearing.
02. The respondents were further directed to ensure that pending
consideration of the matter, no construction is raised in violation of law on the Kacharrai land and the respondents were directed to take a decision preferably within eight weeks from the date the order is served upon them.
03. Since the aforesaid order was not complied with within the time granted by this Court, the instant contempt petition has been preferred in which the notice was issued way back on 17.12.2013.
04. Today, when the instant contempt petition was taken up, there is no representation on behalf of the petitioners, however, learned counsel for the respondents submits that the order/judgment passed by this Court stands S. No. 23

2
complied with and this is the precise reason that there is no representation on behalf of the petitioners.
05. The learned counsel appearing on behalf of the respondents has drawn the attention of this Court to the compliance report which has been filed on behalf of the respondents on 02.04.2025.
06. A perusal whereof reveals that the petitioners have filed reference against the mutation No. 275 of village Mawa Krora Tehsil Akhnoor attested on 03.02.2010 before the Court of Financial Commissioner, Revenue, J&K, Jammu and the Hon’ble Court of Financial Commissioner, Revenue J&K vide order dated 27.06.2018 set aside the impugned mutation No. 275 and remanded the matter to Tehsildar concerned who has been directed to attest a fresh mutation in accordance with the law governing the subject.
07. Thus, in compliance to the order passed by the learned Writ Court, the respondents have taken a specific stand that the mutation No. 275 has been set aside by the respondents on 06.03.2025 and that fresh notices will be served to the interested parties before attesting the mutation afresh.
08. Thus, in the light of the stand taken by the respondents, no fruitful purpose will be served to keep this contempt petition alive as the order/judgment as per the learned counsel for the respondents, stands complied with.
09. Accordingly, the proceedings in the instant contempt petition are closed.
10. Rule, if any, shall stand discharged.
11.
Disposed of, accordingly.
