JUSTICE PARTHIVJYOTI SAIKIA ORDER Date : 26-03-2025 Heard Mr. M. Doji, learned counsel appearing for the applicant and Mr. T. Ete, learned Additional Public Prosecutor for the State of Arunachal Pradesh. This is an application under Section 483 of BNNS, 2023 praying for granting bail to the alleged accused person, namely, Shri Kento Bagra, who is detained in judicial custody in connection with Aalo P.S. Case No. 14/2025 under Sections 21(a)/27(a) of Narcotic Drugs and Psychotropic Substances Act, 1985. Page No.# 2/2 The case of the applicant is that the accused, Shri Kento Bagra is accused of committing offences under Sections 21(a)/27(a) of NDPS Act. It is a settled position of law that the offences under Sections 21(a)/27(a) of NDPS Act are punishable up to one year of imprisonment. In a similarly situated case, the coordinate Bench of this Court in Crl.Petn. No. 814/2019 had directed the applicant, therein, to approach the Trial Court for seeking bail as both the offences are bailable. In view of the above, the present applicant is directed to approach the learned Trial Court for seeking bail under Section 478 of the BNSS, 2023. The present bail applicant stands disposed of.
