1.PUBLIC PROSECUTOR The Coult Made the foIIowincI Order: This Criminal Petition, under Sections 480 and 483 of BNSS, has been filed by the petitioners herein/accused Nos.1 and 2, seeking regular bail, in Crime No.16 of 2025 of Prohibition and Excise Station, Guntur-II, registered for the offence punishable under sections 8(c) read with 21(b) (2) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short the NDPS Act,. 2. Case of the prosecution, in brief, is that, on 18.01.2025 at about 09.30 p.m., the Prohibition & Excise Inspector along with his staff and mediators rushed to East Side road margin, Ravindra Nagar to Shyamala Nagar Road, and found the accused in possession of 7 Drug (Cocaine) Packets having 8.50 grams weight.
The contraband along with other material was seized under the cover of mediators report. 3. Heard. Perused the record. '-,~rf- /

Learned counsel for the petitioners subm-Its that the petitioners are in judicial custody since 19.01.2025 and the contraband allegedly seized from the possession of the petitioners herein is not a commercial quantity. Learned counsel for the petitioners further submits that the petitioners have permanent abode and there is no possibility of their fleeing away from the jurisdiction of the Court. Learned Assistant Public Prosecutor has not disputed the submissions made by the learned counsel for the petitioners. 5. The petitioners are in judicial custody since 19.01.2025. It is submitted by the learned Assistant Public Prosecutor that the petitioners herein have no previous crime record. As most of the investigation might have been completed by this time, the release of the accused would not cause hampering of investigation. 6. In view of the aforesaid facts and circumstances of the case and considering the remand period of the petitioners herein, this Court is inclined to grant bail to the petitioners herein/accused Nos.1 and 2. 7. Accordingly, the Criminal Petition is allowed. The petitioners herein/accused Nos.1 and 2 shall be released on bail on each of them executing a personal bond for a sum of Rs.2O,00O/- (Rupees Twenty Thousand only) each with two sureties of the like sum each to the satisfaction of the learned Judicial Magistrate of First Class for Prohibition and Excise, Guntur.
