... Non-applicant For Applicants : None. For Non-Applicant : Mr. Amit Verma, Panel Lawyer. Hon'ble Mr. Ramesh Sinha, Chief Justice Order on Board 23.09.2025
1. This is the first bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicants who have been arrested in connection with Crime No. 01/2025 registered at Police Station, Chilfi, District Kabirdham (C.G.), for the offence punishable under Section 20(B)(ii)(C) of the Narcotic Drugs and Psychotropic Substances Act, 1985. 2. As per the prosecution, on 01.01.2025, Inspector Umashankar of Chilfi Police Station received information from a mukhbir that two persons were ABHISHEK SHRIVAS Digitally signed by ABHISHEK SHRIVAS Date: 2025.09.23 17:41:19 +0530
2 transporting illegal narcotic substance (ganja) towards Kawardha, Chilfi, on the Jabalpur route, in a Maruti Suzuki car bearing registration number HR-20-0369. Acting on this information, Inspector Akhilesh Vaishnav, along with independent witnesses, necessary materials, and accompanying staff, reached the spot to take action under the NDPS Act. During the raid, a car was intercepted, and its occupants were surrounded and apprehended. There were two persons in the car, who, upon questioning, disclosed their names as Sharawan and Ramchandra. The accused were arrested under Section 20(B)(ii)(C) of the NDPS Act after being informed of their rights under the law. Upon a proper search, three white plastic bags containing 17 packets of ganja wrapped in brown tape, weighing a total of 34.420 kg, were recovered. Accordingly, an offence was registered against the applicants. 3. None appears nor is any representation made on behalf of the applicants to press this application when the case is called out. 4. It transpires from the record that the applicants are in jail since
01.01.2025. Hence, the Court proceeds to consider and hear the bail application of the applicants with the assistance of the State counsel. 5. Mr.
Amit Verma, learned Panel Lawyer, appearing for the State/non- applicant would oppose the bail application and submit that the charge- sheet has been filed in the present case before the competent Court. He further submits that the quantity of contraband article i.e. 34.420 Kgs of Ganja was recovered from the joint possession of the present applicants, which is much above the commercial quantity and as such, the applicant is not entitled to be released on bail. 6. I have heard learned counsel appearing for the parties and perused the case diary. 3
7. From perusal of the case diary, it transpires that the article which has been seized from the joint possession of the present applicants is much above the commercial quantity and it cannot be a case of false implication. 8. Accordingly, the bail application of the applicants - Ramchandra & Shrawan Kumar filed under Section 483 of the BNSS, involved in Crime No. 01/2025 registered at Police Station, Chilfi, District Kabirdham (C.G.), for the offence punishable under Section 20(B)(ii)(C) of the Narcotic Drugs and Psychotropic Substances Act, 1985, is rejected. 9. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 10. Office is directed to send a certified copy of this order to the trial Court concerned for necessary information and compliance forthwith. - Sd/-
