The learned counsel for the petitioner submits that the petitioner was arraigned as A.1 in Crime No.385 of 2024 of Punganur Urban Police Station. Chittoor District, registered for the alleged offence under Section 127(3), 351(2), 64(1) of the Bharatiya Nyaya Sanhita, 2023 and Sections 3(a) read with Section 4 of the Protection of Children from Sexual Offences Act, 2012. 3. The learned counsel further submits that the provisions of the POCSCO Act are not applicable as the victim girl was aged more than 18 years as on the date of the alleged offence. 4. The learned Assistant Public Prosecutor submits that in the preliminary enquiry, it was found that the petitioner was a minor girl on the date of the alleged offence, and the police have secured the details of the date of birth from the school. 5. Considering the submissions, this Court is not inclined to interfere with the allegations made in the complaint and the criminal petition is liable to be dismissed. 6. Accordingly, the criminal petition is dismissed. 7.
