1. This contempt petition has been filed alleging non-compliance of the order dated 27.09.2024 passed by this Court in Writ Petition (S) No. 6044 of 2024 passed by this Court. 2. This Court has passed the following order in WPS No. 6044 of 2024, in paragraph 5, annexed as Annexure- C/1. “5. Taking into consideration the facts and circumstances of the case, nature of grievance raised, submission of counsel for the
2 respective parties in particular, submission of the counsel for the petitioner that the petitioner is a retired employee, Respondent No. 4 has already calculated the amount due to the petitioner under the head of “leave encashment” about more than 01 year ago and therefore, the writ petition at this stage is disposed of, with a direction to the Respondent No. 2 & 4 to disburse the amount of Rs.9,34,192.00/- as calculated expeditiously, preferably within a period of 03 months from today.”
2. At the outset, learned counsel for the applicant submits that the order under contempt has been complied with, but interest, on the outstanding amount of Rs. 9,34,192/-, has not been paid. 3. In reply, counsel for respondent No. 2 submits that in the order under contempt dated 27.09.2024 passed in WPS No. 6044 of 2024, no direction has been issued with regard to payment of interest on the outstanding amount of Rs. 9,34,192/-. He further submits that aforesaid principal amount of Rs. 9,34,192/- has already been paid to the applicant. 4. I have heard learned counsel for the parties and perused the material available on record. 5. Thus, since the order under contempt has been complied with by respondent No. 2, therefore, I do not find any reason to proceed further in the matter initiating contempt proceeding against the respondents. 6. Accordingly, contempt proceeding is dropped.
No order as to costs. Sd/-
