1. By the present writ petition, the petitioner, whose late mother was in Govt Service died in harness on 19/10/2019 and was working on the post of Female Health Worker in the respondent Department at Kurrutola, Block Doundi, District Balod, is seeking a direction towards the respondent authorities for grant of employment on compassionate ground and also seeking for family pension and retiral dues with respect to her late mother.

Learned counsel appearing for the petitioner would submit that the petitioner being a dependent daughter to her late mother submitted several representations dated 04/12/2019, 15/06/2021 & 15/03/2022 (Annexure P/3 Colly.) before the respondent No.4/ Chief Medical and Health Officer, District Balod by reiterating her claim but till date, no steps has been taken either for grant of employment on compassionate ground or for payment of retiral dues.

Learned counsel appearing for the State would submit that if the applications/representations submitted by the petitioner are still
3 / 3 pending before the respondent authorities, the same shall be considered in accordance with law, within the stipulated period.
4. I have heard learned counsel for the parties and perused the documents.
5. It is not in dispute that the mother of the petitioner was working in the respondent Department on the post of Female Health Worker and died on 19/10/2019. The petitioner being a dependent daughter to her late mother submitted several representations before the respondent authorities seeking retiral dues as well as employment on compassionate ground however, the same are not being decided by the concerned authorities till date.

In view of the above submission made by learned counsel for the State, the respondent No.4/ Chief Medical and Health Officer, District Balod is directed to consider and decide the representation/ application dated 15/06/2021 (Annexure P/3), if it is still pending, in accordance with law, within a period of 45 days from the date of receipt of a copy of this order.
7. With the aforesaid direction, the Writ Petition stands disposed of. Sd/- (BIBHU DATTA GURU)
