This is the First bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 64/2024 registered at Police Station – Dongripali, District Sarangarh - Bilaigarh (C.G.), for the offence punishable under Section 20(B) of the Narcotics Drugs and Psychotropic Substances Act. 2. As per the brief prosecution story, Police Station Dongripali received secret information from an informant that on 09.11.2024, some unknown persons were transporting illegal contraband ganja in a pickup vehicle bearing registration No. U.P. 70 N.T. 7701 for the purpose of sale. Acting on the said information, the police seized 89.320 kg of contraband ganja ABHISHEK SHRIVAS Digitally signed by ABHISHEK SHRIVAS Date: 2025.09.12 18:50:31 +0530 2 from an open place at the spot of the incident. Consequently, an offence punishable under Section 20(B) of the N.D.P.S. Act was registered against the other accused persons. 3. Learned counsel for the applicant submits that the present applicant has been falsely implicated in this case and the alleged contraband article i.e. 89.320 Kgs of was not seized from the joint possession of the present applicant and other co-accused person. He also submits that the present applicant has no criminal antecedents and he is in jail since 09.11.2024, and conclusion of the trial may take some time, therefore, he prays for grant of regular bail to the present applicant. 4. On the other hand, learned State counsel opposes the bail application of the present applicant and submits that in the present matter the charge- sheet has been submitted before the competent Court. He further submits that the bail of other co-accused person, namely, Vipin Pal has already been rejected by this Court in MCRC No. 7056 of 2025 has already been rejected by this Hon’ble Court, vide order dated 04.09.2025, therefore, the bail application of the present applicant is also entitled to be rejected. 5. I have heard learned counsel appearing for the parties and perused the case diary. 6. Considering the facts and circumstances of the case and the fact that the bail of other co-accused person, namely, Vipin Pal has already been rejected by this Court in MCRC No. 7056 of 2025 has already been rejected by this Court, vide order dated 04.09.2025 on merits, therefore, the bail application of the present applicant is also entitled to be rejected. 7. Accordingly, the bail application of the applicant – Ajay Prajapati, filed under Section 483 of the BNSS, involved in Crime No. 64/2024 3 registered at Police Station – Dongripali, District Sarangarh - Bilaigarh (C.G.), for the offence punishable under Section 20(B) of the Narcotics Drugs and Psychotropic Substances Act, is rejected. 8. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 9.
