Learned counsel for the petitioner submits that an application under Section 39, 40 of the Indian Evidence Act, 2023 read with Order 16 Rule 2 (2) of the CPC was filed for examining the signatures on the agreement to sale executed between the petitioner and the respondent, said application was rejected inter-alia stating that in the written statement filed by the petitioner before the learned trial Court, they have admitted the execution of the agreement (Annexure P/2). She submits that the execution of the agreement was specifically denied by the petitioner. Therefore, the impugned order is bad in law.
