The applicant has preferred this First Bail Application under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Crime No.05/2025, registered at Police Station: Raghunath Nagar District – Balrampur-Ramanujganj, Chhattisgarh for the offences punishable under Sections 20 (b) and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985, for short, the NDPS Act, 1985. As per the prosecution story, on 12.01.2025, Police Officers searched a vehicle at the Tungva check post in the village. They stopped a white Tata Jest car coming from Wadrafnagar and seized 70.180 kg of cannabis (ganja) from the joint possession of the applicant and co-accused. The police then registered an FIR at Raghunath Nagar police station under Section 20(b) and 29 of the NDPS Act, 1985, and arrested the applicant. 3. It has been argued by the learned counsel for the applicants that the applicants are innocent and have been falsely implicated in this case. It is further submitted that the charge-sheet has been filed. The applicants are in jail since 12.01.2025. The conclusion of the trial is likely to take some time, therefore, he prays for grant of bail. 4. On the other hand, the learned counsel for the State opposes the bail application and submits that the quantity of 70.180 Kgs of cannabis (ganja) seized from the joint possession of the applicant and co-accused, which is much more than the commercial quantity. Further, the charge-sheet has been submitted. He further submits that the bail application of the co-accused person has already been rejected by this Court vide order dated 04.02.2025 passed in MCRC No. 1011/2025. Hence, his bail application is liable to be dismissed. 5. I have heard learned counsel for the parties and perused the material available on record. 6. Taking into consideration the fact that quantity of contraband article i.e. 70.180 Kgs of cannabis (ganja) seized from the joint possession of the applicant and co-accused, which is much more than the 3 commercial quantity and further the charge-sheet has been submitted and the bail application of the co-accused person has already been rejected by this Court vide order dated 04.02.2025 passed in MCRC No. 1011/2025, this Court is of the opinion that it is not a fit case to enlarge the applicant on regular bail. 7. Accordingly, the bail application of applicant Nos. 1 and 2 – Lal Singh and Pawan Kumar Yadav, respectively involved in Crime No.05/2025, registered at Police Station: Raghunath Nagar District – Balrampur-Ramanujganj, Chhattisgarh for the offences punishable under Sections 20 (b) and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985, for short, the NDPS Act, 1985, is rejected at this stage. 8. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 9.
