[2025:RJ-JP:50829] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 13336/2025 Jagdish Arya S/o Chunnilal, R/o House No. 186, Gali Number-1, Second Floor Tower Wali Gali, Surya Vihar Colony, Sethpur, Police Station Sethpur Pulla, District Faridabad (Hariyana) (At Present Confined In Central Jail, Ajmer). ----Petitioner Versus The State of Rajasthan through Public Prosecutor ----Respondent For Petitioner(s) : Mr. Aayush Agarwal, Advocate For Respondent(s) : Mr. Onkar Singh Rajpurohit, P.P. HON'BLE MR. JUSTICE VINOD KUMAR BHARWANI Order 16/12/2025 Instant bail application has been preferred under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the petitioner, namely Jagdish Arya in a case arising out of First Information Report No.283/2025 registered at Police Station Pushkar District Ajmer for offences punishable under Sections 310 (4), 313 & 111 (3) of B.N.S., 2023. Submissions of learned counsel appearing for the petitioner are that the petitioner has falsely been implicated in the present case, he has nothing to do with the alleged offence and he is behind the bars since 18.09.2025. In the present case, after investigation, charge-sheet has been filed. The trial of the case is likely to take a long time to conclude, till then, his further incarceration would not serve any fruitful purpose and he is ready & willing to furnish his bail bonds. Therefore, the bail applications deserve to be allowed. Learned Public Prosecutor for the State has vehemently opposed the bail application. [2025:RJ-JP:50829] (2 of 2) [CRLMB-13336/2025] Heard learned counsel appearing for the accused-petitioner as well as the learned Public Prosecutor for the State and perused the material made available on record. Considering the overall facts & circumstances of the case and the submissions made at bar but without commenting upon detailed merits of the case, this Court deems it proper to enlarge the petitioner on regular application. Accordingly, the bail application under Section 483 of B.N.S.S., 2023 is allowed and it is, hereby, ordered that the accused- petitioner, namely Jagdish Arya son of Shri Chunnilal shall be enlarged on bail, if he is not required in any other case, provided he furnishes a personal bond in the sum of Rs.50,000/- (Rs. Fifty Thousand Only) with two sureties of Rs.25,000/- each to the satisfaction of the ld. trial Judge for his appearance before the Court concerned on all the dates of hearing and as and when called upon to do so.
