Order 28/10/2025
1. The petitioners have preferred these bail applications under Section 483 of BNSS in FIR No.274/2024 registered at Police Station Jawaharnagar (Kota City), District-Kota City for offences under Sections 103(1), 109(2), 111(4), 115(2), 126(2) and 189(2) of BNS.
2. Heard learned counsel for the petitioners as well as learned Public Prosecutor and perused the material available on record.
3.
Learned counsel for the petitioners submits that the petitioners have falsely been implicated in these cases. He further submitted that the petitioner’s name has not been mentioned in the FIR, and even the informant, Nikhil Verdhan, in his statement recorded under Sections 180 and 183 of the BNSS, has not named the petitioners. He submits that no specific weapon has been recovered from the present petitioners, and on similar grounds, a Coordinate Bench of this Court has granted bail to the co-accused Govind and Arjun Gurjar vide order dated 05.08.2025. Petitioner- Sunny Damor @ Agariya is behind the bars since 10.12.2024 and petitioners-Tarun Chaudhary and Deepak Singh @ Gajju @ Gajendra Singh are behind the bars since 11.05.2025. Charge- sheet has been filed. The trial of the case may take considerable time, therefore, no fruitful purpose would be served by keeping
[2025:RJ-JP:43164] (3 of 3) [CRLMB-11079/2025] the petitioners in further custody, hence on the ground of parity, the bail application of the petitioners may be allowed.
4. Learned Public Prosecutor has vehemently opposed the bail applications.
5. On consideration of the rival submission and material available on record and deliberating all the facts and circumstances of the case, but without expressing any opinion on the merits/demerits of the case, I am inclined to grant benefit of bail to the petitioners.
6. Accordingly, the bail applications under Section 483 B.N.S.S. is allowed and it is ordered that the petitioners-Tarun Chaudhary S/o Deelip Kumar, Sunny Damor @ Agariya S/o Sher Singh Damor and Deepak Singh @ Gajju @ Gajendra Singh S/o Shri Rajendra Singh shall be released on bail on their furnishing a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each of them to the satisfaction of the learned trial court for their appearance before that Court on all the dates till conclusion of the trial.
