GP FOR REVENUE 3 The Court made the following ORDER: Heard the learned counsel for the petitioners and the learned Assistant Government Pleader for Revenue appearing for the respondents. 2. This Writ Petition was filed questioning the action of the 4th respondent in trying to dispossess the petitioners from the land admeasuring Ac.0.02 ½ cents (Plot No.72), Ac.0.02 ½ cents (Plot No.73), Ac.0.02 ½ cents (Plot No.71), Ac.0.05 cents (Plot Nos.110 & 111) (total Ac.0.12 ½ cents) situated in Sy.No.133/3A and 133/3B of Kurugunta Village, Anantapuram Mandal & District without any order in writing. 3. On the other hand, the learned Assistant Government Pleader appearing for the respondents submits that the 4th respondent, will follow the due procedure with respect to the subject lands, if so warranted and in respect of the other plots, as per the Orders passed in W.P.No.11310 of 2015, dated 09.11.2022. 4. In view of the above said facts and circumstances and upon consideration of the rival submissions made by both the learned counsels, the respondent Nos.2 to 4 are directed to deal with the subject lands in an extent of Ac.0.02 ½ cents (Plot No.72), Ac.0.02 ½ cents (Plot No.73), Ac.0.02 ½ cents (Plot No.71), Ac.0.05 cents (Plot Nos.110 & 111) (total Ac.0.12 ½ cents) situated in Sy.No.133/3A and 133/3B of Kurugunta Village, Anantapuram Mandal & District, strictly in accordance with the law, if so warranted for any public purposes. If the petitioners are otherwise in 4 possession of the same, they shall be dealt with strictly in accordance with the law by hearing all the parties concerned, including the petitioners, giving them due opportunity and upon verification of the records and the subject lands/ plots, appropriate decision shall be taken on its own merits. Any dispossession from the subject lands/ plots shall not be made except by following the due procedure. 5. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.
