This appeal is directed against the order dated 28.10.2024 passed by the learned District & Additional Sessions Judge-I, Giridih in M.C.A. No.1768/2024, arising out of Madhuban P.S. Case No.20/2016, corresponding to S.T. Case No.47/2024, whereby and whereunder, the prayer for bail of the appellant has been rejected.
It has been alleged that an explosion had occurred in the house of Uday Mahto due to bombs having been planted by the extremists, which resulted in the building getting demolished. Submission has been advanced by the learned counsel for the appellant that unknown persons have named the appellant as one of the persons who was involved in the commission of offence. It was further submitted that the appellant is in custody since 18.10.2023 and the trial has not yet progressed.
Mr. Prabir Kumar Chatterjee, learned Special P.P. has opposed the prayer for bail of the appellant and has submitted that the appellant has got several criminal antecedents. Regard being had to the manner of implication of the appellant and the period of custody undergone by him, we, while setting aside the order dated 28.10.2024 passed by the learned District & Additional Sessions Judge-I, Giridih in M.C.A. No.1768/2024, arising out of Madhuban P.S. Case No.20/2016,
corresponding to S.T. Case No.47/2024, direct that the appellant, above named, be released on bail, on furnishing bail bond of Rs. 10,000/- (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned District & Additional Sessions Judge-I, Giridih, in connection with M.C.A. No.1768/2024, arising out of Madhuban P.S. Case No.20/2016, corresponding to S.T. Case No.47/2024. This appeal is allowed.
