IN THE HIGH COURT OF ORISSA AT CUTTACK W.P.(C) No.37615 of 2025 Abhiram Dutta …. Petitioner Mr. N. Jena, Adv. -versus- State of Odisha & Others …. Opp. Parties Mr. S. Das, ASC CORAM: JUSTICE BIRAJA PRASANNA SATAPATHY Order No ORDER 06.01.2026 01. 1. This matter is taken up through Hybrid Arrangement (Virtual/Physical) Mode. 2. Heard learned counsel for the parties. 3. The present Writ Petition has been filed inter alia challenging rejection of the petitioner’s claim to get the benefit of appointment under the Rehabilitation Assistance Scheme vide the impugned communication dated 03.12.2024 under Annexure-7. 4. Learned counsel for the petitioner contended that even though petitioner on the death of his father, made an application but the same was rejected without proper appreciation of his claim. 5. Learned Addl. Standing Counsel on the other hand contended that since petitioner’s father was working as NMR only and benefit of appointment under Rehabilitation Assistance Scheme is not available to such employees, no illegality or irregularity can be found with the impugned rejection. 6. Having heard learned counsel for the parties, considering the submissions made and the fact that the deceased employee was working as a NMR, this Court finds no illegality or irregularity with the impugned rejection and accordingly is not inclined to interfere with the same and dismiss the Writ Petition. 7. The Writ Petition stands dismissed accordingly. (Biraja Prasanna Satapathy) Judge Basudev
