The applicant/petitioner has filed the present application for condonation of 93 days' delay in filing the revision. It has been asserted that the applicant received the copy of the judgment passed by the learned Session Judge, Una, District Una, H.P on 25.06.2024. She came to Shimla to engage a lawyer, but could not engage any lawyer due to financial issues. She was arranging money for engaging the lawyer and depositing it before the learned trial Court. She also remained under the impression that the revision could be filed within six months from the date of the order. The applicant has a very good case with her. Hence, it was prayed that the present application be allowed and the delay in filing the revision be condoned.

The application is opposed by filing a reply taking preliminary objection regarding lack of maintainability. It was asserted that the delay in filing the revision has not been properly explained. The revision was filed after the period of limitation. Therefore, it was prayed that the present application be dismissed.

I have heard the counsel for the parties and have gone through the records carefully.

The applicant asserted that she was unable to arrange
money to pay the fee of her lawyer and deposit the part of compensation before the learned trial Court. This plea is duly supported by an affidavit, and there is no reason to disbelieve it at this stage. Poverty cannot be a reason to deny justice to a party. Therefore, the applicant had a sufficient cause for the condonation of delay.

In view of above, the present application is allowed, and the delay in filing the revision is ordered to be condoned.
