JUSTICE ARUN DEV CHOUDHURY ORDER Date : 28.02.2025 Heard Mr. T. Taba, learned counsel for the petitioner. Also heard Mr. T. Tagum, learned Standing Counsel, Education Department, Government of Arunachal Pradesh and Mr. S. Tapin, learned Senior Government Advocate, State of Arunachal Pradesh represent the State respondents. 2. The petitioner was Upper Division Clerk in the Directorate of Elementary Education, Government of Arunachal Pradesh, Itanagar. 3. The petitioner claims to be a ministerial staff of Directorate of Elementary Education, Government of Arunachal Pradesh and he has been transferred as UDC in the office of the Deputy Director of School Education, Kra Daadi District, Arunachal Pradesh by an order dated 17.01.2025. He is aggrieved by the aforesaid order. 4. The basic contention of the petitioner is that the School Education has been bifurcated into two directorates i.e. Directorate of Elementary Education and Directorate of Secondary Education and therefore, according to the petitioner, his transfer from Elementary Education to the office of the Deputy Directorate of School Education, is a transfer outside cadre. 5. Mr. Tagum, learned Standing Counsel for the Education Department on instruction submits that the petitioner has already been released from the Page No.# 3/3 present post of posting pursuant to the impugned transfer order, by an order dated 21.02.2025. 6. At this stage, learned counsel for the petitioner submits that he has filed a representation before the respondent No. 2 and accordingly he prays that a direction may be issued to the respondent No. 2 to consider his representation and in that count, writ petition may be disposed of. 7. Considering the limited nature of prayer, this writ petition stands disposed of with a direction to the respondent No. 2 to consider the representation dated 31.01.2025 filed by the petitioner within a period of 10 (ten) from today and pass a speaking order thereon.
