Learned counsel for the petitioner would submit that the respondents have not taken any prior sanction of the Governor of Chhattisgarh before withholding the pension of the petitioner as required under Rule 9 of the Chhattisgarh Pension Rules, 1976. He would further submit that respondents have already released by issuing order regarding leave encashment, GIS and GPF payments, acknowledging the petitioner’s service and entitlements, therefore any deviation or withholding of Gratuity and Pension in arbitrary and contrary to settled principles of service jurisprudence.

Learned counsel for the State would submit that under guidance of the petitioner tree plantation work was carried out but he has discharged his duty negligently, therefore vide order dated 20.01.2025 as per Rule 10(iii) of the Chhattisgarh Civil Services (Conduct) Rules, 1965 recovery amount to the tune of Rs. 95,016/- against the petitioner has been ordered.
4. I have heard learned counsel for the parties and perused the records.
5. Considering the submissions, it is directed that the amount of Rs. 95,016/- be retained and rest of the pension/gratuity amount be paid to the petitioner within 15 days from the date of receipt of copy of this
order and the petitioner is at liberty to challenge the order dated 20.01.2025 before appropriate forum.
6. With this direction, the instant writ petition is disposed of.
