A case has been offence punishable u/Sec.310(2) of B.N.S. 3. Case of the prosecution, in brief, is that, the defacto complainant is a resident of Pedda Sariyapalli, Srikakulam District. On 18.01.2025 in the afternoon hours, he received a phone call and he disconnected the same. Again on 19.01.2025 in the morning hours while he was returning from received phone call from the same number and from Narayana school, he the same unknown lady who informed that she is very known to him and 2 enquired his details. She asked him to come to Mudugullu area as she was coming to meet him and that he came to ANITS college junction. When he was waiting there, A1 to A6 approached him and informed that he kidnapped one lady and took him away from there. A4 and A5 took the defacto complainant on a scooty and took him to Raghu engineering college. A1 to A3 followed them on scooty and A6 followed on another scooty. A1 to A6 took the defacto complainant to an isolated place on the left side of Fortune hills lay out, near Raghu engineering college. Then A3 and A6 caught hold of the defacto complainant rightly and detained there, whereas A1 to A6 threatened and beat him. Further A1 fisted on his face and robbed his phone and threatened him to disclose his phonepe password. They took cash of Rs.40,000/- from phonepe app. Thereafter A1 to A6 threatened the defacto complainant with dire consequences not to disclose the said incident to anyone and left him. A1 to A7 hatched a plan and bring the defacto complainant to the isolate place and robbed the money. Basing on the complaint of the defacto complainant, the above said crime was registered and investigated into. Heard. Perused the record. Learned counsel for the petitioners submits that similarly placed person i.e. A4 has obtained regular bail by this Court in the very same crime, vide order in Crl.P.No.2031 of 2025, dated 27.03.2025. The case of the present petitioners i.e. A1 and A5 is also on the same footing as that of 4. 5. A4. 3 6. On the other hand, learned Assistant Public disputed the correctness of the counsel for the petitioners.
