Learned senior advocate Mr. Jal Unwalla appearing with learned advocate Mr. Ankit Shah for the applicant, under instructions, states that in view of the fact that if a Special Criminal Application under Article 226 is preferred the same by way of that petition, the petitioner would be seeking the Court to exercise a wider powers and therefore instead of proceeding further with the present petition, learned senior advocate Mr. Unwalla seeks permission to file a fresh writ petition with same or additional prayer. R/CR.MA/13339/2025 ORDER DATED: 10/07/2025 2. Learned senior advocate Mr. Unwalla also apprised the Court about the fact that vide order dated 21.1.2025 passed in Special Criminal Application No.49439 of 2024, this Court had permitted the petitioner to withdraw that petition with a view to file fresh applications separately qua each FIR. However, the said order would not come in the way of the petitioner in filing another Special Criminal Application for the reason that by way of this petition, the petitioner has challenged only one FIR and therefore, the intention of the petitioner is to challenge the FIR separately by way of separate proceedings. 3. Accordingly, permission as prayed for is granted. The present petition stands disposed of with the above liberty. It is clarified that this Court has not gone into the merits of the matter.
