ORDER:
1. Heard the
learned counsel for the petitioner and the learned Assistant Public Prosecutor appearing for the State.
2. The learned counsel appearing for the petitioner submits that the petitioner was arraigned as A.6 in Crime No.99 of 2025 of Mydukur Police Station, YSR Kadapa District, registered for the offence under Sections 420, 466 read with Section 34 of the Indian Penal Code, 1860.
3. The
learned counsel for the petitioner submits that the 2nd respondent has filed a false complaint, alleging that the petitioner forged and fabricated documents related to the land belonging to her. It is further submitted that there is an abnormal delay in filing the complaint and that the alleged incident occurred in the year 2022, however the complaint was filed in the year 2025. The
learned counsel also submits that the petitioner is undergoing surgery and has filed medical records pertaining to the scheduled procedure and therefore, a direction is sought to the Station House Officer to follow the procedure contemplated under Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023, in connection with the crime and to grant time to the petitioner to submit a reply.
4. Considering the submissions, the Station House Officer is directed to issue a notice to the petitioner under Section 35(3) of the
V -2- CRLP.No.2926 OF 2025 Bharatiya Nagarik Suraksha Sanhita, 2023, and after the scheduled surgery is completed,grant adequate time to respond to the notice.
5. With the above, the criminal petition is disposed off.
6. Miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
