mM, 2 The Court made the following order: The petitioners filed writ petition vide WP No.8797 of 2021 questioning the action the respondents in trying to dispossess them from the lands admeasuring an extent of Ac.4.54 cents in Sy.No. 100/2, an extent of Ac. 1.30 cents in Sy.No.88/1 and extent of Ac.0.42 cents in Sy.No.89/5 respectively situated in Adusupalyem Village, Renigunta Mandal, Chittoor District, without following the due process of law. This Court, by order dated 21.06.2021, directed both the parties to maintain status quo for a period of two weeks and subsequently, the same was extended from time to time. It is further case of the petitioners that, the said
order was communicated to the respondents. Initially the respondents kept quite in the matter, but later
2. started making constructions over the lands in dispute and thereby violated the orders passed by this Court. It is further stated that, a representation was made on 03.09.2021, requesting the respondents not to proceed with the constructions. Despite the same, the respondent proceeded with the constructions. Therefore, the present contempt petition is filed.
3 On the other hand, the respondents filed separate counter affidavits and additional counter affidavit filed by 3^^ respondent
3. stating that, the subject lands are classified as AWD and no one was granted assignment in respect of the said lands. It is further stated that, the said lands were proposed and acquired to provide house site pattas to the eligible beneficiaries under Navaratnalu Pedalandariki lllu Scheme and in that connection, a layout was formed and house site pattas were distributed on 28.12.2020, to the eligible beneficiaries and the subject lands are in possession of the beneficiaries. The process of land acquisition i.e., Form-C notification was concluded on 13.12.2019, under Act 30 of 2013 and the same was published in District Gazette on 01.01.2020, thereafter meetings were held on various dates. During the said meetings, the petitioners did not raise any objections. It is further stated that, since the petitioners are not in possession of the lands in dispute, the question of dispossessing them does not arise. It is further stated that, as on the date of filing of the writ
4. petition, there were no constructions over the subject lands and thereafter, some structures were raised by the beneficiaries, it is further stated that, on receipt of interim order dated 21.06.2021,
4 the respondents informed the beneficiaries not to proceed with the constructions till the disposal of the writ petition filed by the petitioners. It is further stated that the respondents did not violate the orders of this Court and prayed to dismiss the writ petition. Heard counsel for the petitioners and learned Assistant

6. It is the case of the petitioners that, subsequent to the orders passed by this Court, the respondent proceeded with the constructions over the lands in dispute by violating the interim
order. Nothing is placed on record to show that the respondents have flouted the
order. Further, on a perusal of the counter affidavits and additional counter affidavit filed in the instant contempt case, it is categorically stated that, the petitioners were never in possession of the subject lands. Apart from the same, the respondents after following the procedure contemplated under Act 30 of 2013, a layout was formed and house site pattas were distributed in favor of eligible beneficiaries. It is categorically averred in the counter affidavit that the beneficiaries in whose favor house site pttas were granted started making constructions

over the said lands. Further, the respondents prevented the beneficiaries not to proceed with the constructions till the finalization of the writ petition filed by the petitioners and accordingly, the beneficiaries stopped the constructions.
8. As already noted supra, except making a bald statement in the affidavit filed in support of the contempt case, nothing is placed on record to show that the respondents have violated the
order dated 21.06.2021, passed in the writ petition. In the absence of any material, the contempt petition filed by the petitioners cannot be entertained and accordingly, the dismissed. same is As a sequel, miscellaneous petitions pending, if any, shall stand closed.
