It is admitted by the learned counsel for petitioner that the petitioner has made construction illegally in the Government land to an extent of Ac.O.OScents or 242 square yards situated in R.S.No.430 of Pallepalem Village, Kruthivennu Mandal, Krishna District and the respondents are trying to demolish the said construction and to dispossess the petitioner from the subject land without following the due process of law, which amounts to violation of principles of natural justice. Hence, learned counsel requested this Court to direct the 3. 3 respondents before initiating any action against the subject land, the respondents shall follow the procedure as established by law. 4. Learned Standing Counsel appearing for the 4 Gram Panchayat has furnished the written instructions 22.01.2025 of the Panchayat Secretary, Pallepalem Gram Panchayat, Kruthivenu Mandal, Krishna District, it transpires that some of the villagers have made a complaint against the petitioner that the petitioner has constructed shops illegally in the subject land and basing on the said complaint, the authorities have conducted enquiry and a show cause notice was issued to the petitioner, however, the petitioner has not removed the said construction, and therefore, the present impugned proceedings, dated 16.01.2025 issued directing the petitioner herein for removal of the illegal construction. respondent/ dated an was Learned counsel appearing for the petitioner would submit that the impugned proceedings, dated 16.01.2025 was issued without prior notice, hence, sought a direction to the respondents to follow the due process of law before initiating any action against the subject property. 5. any 6. Acceding the request made by the learned counsel for the petitioner, this Court is inclined to dispose of this writ petition with a direction to the petitioner herein to submit explanation with all relevant documents to the impugned notice, dated 16.01.2025, treating the 4 show cause notice, within a period of two weeks from today same as and on filing of such explanation by the petitioner, the respondents are directed to examine the same and pass appropriate orders and communicate the said decision to the petitioner herein. Till such time, directed not to take any coercive steps against the respondents are the petitioner. 7. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.
