The applicant is in judicial custody in FIR No.603 of 2024, dated 24.07.2024, under Sections 8/20/29/60 of the Narcotic Drugs and Psychotropic Substances Act, 1985, Police Station Kotwali Jwalapur, District Haridwar. He has sought his release on bail.

Heard learned counsel for the parties and perused the record.

According to the FIR, Ganja in commercial quantity was recovered from the co-accused on
24.07.2024. They revealed that they have brought the Ganja from the applicant.

Learned counsel for the applicant would submit that the co-accused from whose possession the alleged article was recovered, have already been granted
2 bail; there is no evidence against the applicant except the statement of the co-accused.

Learned State counsel admits these facts, but she would submit that there is some call detail records, which reveals that the applicant was in touch with the co- accused from whose possession Ganja was recovered.

Having considered, this Court is of the view that it is a case fit for bail and the applicant deserves to be enlarged on bail.

The bail application is allowed.

Let the applicant be released on bail, on his executing a personal bond and furnishing two reliable sureties, each of the like amount, to the satisfaction of the court concerned.
