With the consent of the parties the matter is heard finally. 2. The fact of the case in brief is that there is some dispute with regard to the nazul land possessed by the petitioner, therefore, the petitioner has moved an application for obtaining certified copy of naksha Batankan (map) of the Nazul Land bearing Khasra No. 132/10, 132/13, 132/16, 132/19, 132/20 and khasra No. 130/1 to 130/7 situated at Digitally signed by JYOTI JHA Date: 2025.09.18 12:02:51 +0530 2 Ramanujganj, Tahsil Ramanujganj, District Balrampur-Ramanujganj (C.G.) and has also deposited the requisite fee on 02.06.2025 before the respondent No. 7, but the same has not been provided by him. 3. Learned counsel for the petitioner submits that feeling aggrieved with the aforesaid part of the respondent No. 7, the petitioner has made representation before the higher authority, but they have not considered the same till date. The petitioner has also send a legal notice through the counsel but the same has also not been replied by him, till date. The aforesaid documents are necessary for proper adjucation of the case of the petitioner filed under Section 145 & 146 of Cr.P.C. but in absence of the aforesaid documents, the petitioner will deprived from his legal right. The duty cast upon the respondent authorities to provide the certified copy of the public document as per Section 75 of the Bhartiya Sakshya Adhiniyam, 2023, but the respondent authorities are not complying with the same. Hence this petition. 4. Learned counsel for respondents submits that in view of the limited prayer made by the learned counsel for petitioner seeking direction to respondent-authorities to consider the pending application, he is having no objection to the limited prayer and pending application dated 02.06.2025 will be considered in accordance with law. 5. I have heard learned counsel for the parties and perused the material available on record. 6. Considering the facts and circumstances of the case instead of keeping this petition pending, I find it appropriate to dispose of the same at this stage directing the respondent No. 5 to consider/decide the application of the petitioner (Annexure P-1) dated 02.06.2025 in accordance with 3 law/rules/regulations as expeditiously as possible within a period of 30 days from the date of receipt of copy of this order. 7.
