Neutral Citation No. - 2025:AHC:65977 Court No. - 1 Case :- CONTEMPT APPLICATION (CIVIL) No. - 1710 of 2025 Applicant :- Shyam Bahadur Opposite Party :- Digvijay Singh, Sub Divisional Magistrate Counsel for Applicant :- Daksha Yadav Hon'ble Salil Kumar Rai,J. The present contempt application has been filed pleading willful disobedience of the order dated 23.12.2021 passed by this Court in Public Interest Litigation (PIL) No.2380 of 2021 whereby this Court had directed the Assistant Collector to register and decide the proceedings under Section 67 of the U.P Revenue Code, 2006 (hereinafter referred to as 'Code, 2006') within a period of 90 days after the applicant files an application for the said purpose. The Assistant Collector/Tahsildar has not been arrayed as opposite party in this case. It is the Sub Divisional Magistrate who has been impleaded as a contemnor. The proceedings under Section 67 of Code, 2006 are not registered before the Sub Divisional Magistrate but before the Assistant Collector/Tahsildar. It is apparent that no steps have been taken by the applicant before the Assistant Collector. In view of the aforesaid, the contempt application is not maintainable and is dismissed.
