STATE OF HARYANA …RESPONDENT Coram : Hon’ble Mr. Justice N.S.Shekhawat Present : Mr. R.K. Choudhary, Advocate for the petitioner. Mr. Rajiv Sidhu, DAG, Haryana. *** N.S.Shekhawat J. (Oral) 1. The petitioner has filed the present petition under Section 483 of BNSS, 2023 with a prayer to grant regular bail to him in case FIR No.701 dated 21.11.2024, registered under Sections 204, 318(4), 319 BNS, Police Station Sector-10, District Gurugram. 2. Learned counsel for the petitioner contends that the petitioner has been falsely involved in the present case in collusion with the local police officials as the complainant is a rich and influential person. He further contends that neither the petitioner had threatened or intimidated the complainant nor any amount was received by him. In fact there was a dispute between the complainant and Vijay Chaudhary, co-accused and the petitioner has been made scapegoat. He further contends that Vijay Chaudhary, co-accused has been VIPIN KUMAR 2025.05.16 09:55 I attest to the accuracy and integrity of this judgment/order CRM-M-21000-2025 -2- found innocent during the course of investigation by the police. The police had wrongly arrested the petitioner on 22.02.2025 and is in custody since then. He next contends that the challan has been presented against him and the trial may not conclude in near future. Moreover, the petitioner is a first offender and was never involved in any other criminal activity. 3. On the other hand, learned State counsel has vehemently opposed the submissions made by learned counsel for the petitioner on the ground that the petitioner threatened the complainant by posing himself as an enforcement directorate official and he may influence the witnesses of the prosecution and he does not deserve the concession of bail by this Court. 4. I have heard the learned counsel for the parties and perused the record carefully. 5. No doubt the allegations levelled against the petitioner are serious in nature, but the petitioner is confined in jail for the last about 03 months. The investigation is complete in all respects and challan has been presented against him. Moreover, the trial has not even formally commenced against him and there are no chances of early conclusion of the trial. 6. Without commenting on the merits of the case, the present petition is allowed and the petitioner is ordered to be released on bail subject to his furnishing bail bonds/surety bonds to the satisfaction of the trial Court/Duty Magistrate/Chief Judicial Magistrate, concerned. 15.05.2025 (N.S.
