The petitioner has been made accused in connection with Manika P.S. Case No. 17 of 2024, corresponding to G.R. Case No.296 of 2024 (S.T. Case No.139 of 2024), for the offences registered under Sections 376/506 of the I.P.C., pending in the Court of learned Additional Sessions Judge-II, Latehar. On 27.03.2024 at about 4:20 A.M., the informant had gone outside her house to attend the call of nature. The petitioner is alleged to have over powered her and raped her. Bail Application of the petitioner was earlier permitted to be withdrawn by a Co-ordinate Bench of this Court. Learned counsel for the petitioner submitted that petitioner has been made accused due to the land dispute between the parties and he is in custody since 28.03.2024. Considering the nature of allegation, I am not inclined to release the petitioner, on bail. Accordingly, his prayer for bail stands rejected. Learned trial court shall expedite the trial.
