1. This first anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No.0122/2025 registered at Police Station – Arjunda, District-Balod (C.G.) for the offences punishable under Sections – 115(2), 121(1), 126(2), 191(1), 221, 296, 324(3), 331(3), 351(3) of BNS, 2023.

As per the case of the prosecution, on 17.08.2025, between 9:30 am to 10:30 am the applicant along with other co-accused persons entered the premises of the Electricity Distribution Center, Tehsil – Arjunda, District- Balod expressing their grievances pertaining to an VAISHALI LUCKY NAGARIA Digitally signed by VAISHALI LUCKY NAGARIA Date: 2025.09.12 10:47:11 +0530
2 outage of electrical supply in their village for a duration of three days. In the course of the interaction, the villagers allegedly employed abusive language and issued threats of lethal harm towards the staff members present. The applicant along with other co-accused persons are alleged to have impeded the official duties being performed to have impeded the official duties being performed at the center, engaged in physical altercation with the employees on duty, and specifically, forcible pulled one Purushottam Sahu by his collar and assaulted him. Further, the applicant alongwith other co-accused persons are alleged to have caused damage to certain electrical equipment situated within the office premises and obstructed the flow of traffic on the main road adjacent to the electricity office. Thereafter, FIR has been registered against the accused persons.

Learned counsel for the applicant submits that the applicant is innocent and he has been falsely implicated in the present case. It is argued by learned counsel for the applicant is that present applicant along with other villagers have gone to the Electricity Office for complaining that there is no electricity supply since three days in their village, on account of which said incident took place and the injured sustained simple injuries. Further, co-accused has already been granted bail by this Court in MCRCA No.1315 of 2025 vide
order dated 01.09.2025, investigation and trial are likely to take time, therefore, he submits that the present applicant is entitled to be released on anticipatory bail.
4. On the other hand, learned State counsel opposes the prayer for grant of anticipatory bail.
5. I have heard learned counsel for the parties and perused the case diary.

6. Considering the facts & circumstances of the case, gravity of offence,
submissions made by learned counsel for the parties and also considering the fact that injuries sustained by the injured are simple in nature and the conclusion of the trial is likely to take some time,co-accused has already been granted bail by this Court in MCRCA No.1315 of 2025 vide order dated 01.09.2025, without commenting anything on merits, this Court is of the view that the applicant is entitled to be released on bail in this case on the ground of parity.

Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicant – Roshan Lal, on executing a personal bond and one surety in the like sum to the satisfaction of the arresting Officer, he shall be released on bail on the following conditions:- (a) he shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court. (b) he shall not act in any manner which will be prejudicial to fair and expeditious trial. (c) he shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial. (d) The applicant and the surety shall submit a copy of his adhaar card along with a coloured postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court. (e) he shall not involve himself in any offence of similar nature in future.
