Heard Mr. B.P. Singh, learned counsel for the petitioners. Also heard Mr. Prafull N. Bharat, learned Advocate General along with Mr. Sangharsh Pandey, learned Government Advocate, appearing for the State/respondents. 2. The present petition has been filed by the petitioners under Article 226 of the Constitution of India styled as Public Interest Litigation, seeking following reliefs :- “i. That, in the public interest this Hon'ble Court may kindly be pleased to issue appropriate writ and quash the 'Physical Efficiency Test' for Recruitment, 2023 in light of Advertisement dated 20/10/2023 (Annexure P/2) and further to 'reconduct' the 'Physical Efficiency Test for Recruitment Year, 2023. ii. This Hon'ble Court may kindly be pleased to punish/or to order for initiating departmental enquiry for those officers who were involved in giving/raising higher marks to unsuccessful candidates, illegally or unfairly. iii. That, the Hon'ble Court may kindly be pleased to issue writ/writs, direction/directions, directing a thorough, 3 independent CBI investigation into the manner in which the public servants and stakeholders knowingly allowed such irregularities at the test centers. iv. That, the Hon'ble Court may kindly be pleased to issue writ/writs, direction/directions, directing a registration of a First Information Report under the relevant provisions of the Indian Penal Code and Prevention of Corruption Act against all officers, employees, and the employees of the Respondent No.3” 3. Learned counsel for the petitioners submitted that out of 08 petitioners, 04 petitioners are the selected candidates and they are going to appear in the physical test to be held on 14.09.2025 and so far as the other candidates are concerned, they have also participated in the recruitment process, but as the recruitment process was not fair, hence, the petitioners have come up before this Court with the aforesaid prayers. 4. As out of 08 petitioners, 04 petitioners have to appear in the physical test to be held on 14.09.2025 and other petitioners, whose rights have been infringed, they have the right to challenge the final appointment of the candidates before the appropriate forum, hence, we do not find any good ground for interference in the present matter. 5.
