DEPUTY SOLICITOR GENERAL OF INDIA The court made the following ORDER:- The writ petition is filed under Article 226 of Constitution of India seeking the following main prayer:- “……declaring the action of the respondents, particularly the 2nd and 3rd respondents, in not prohibiting the disbursement of voluntary retirement benefits to the 4th respondent as per the orders in I.A.No. 1773 of 2015 in O.S.No. 386 of 2015 on the file of Senior Civil Judge, Kadapa, dated 04-09-2015, as illegal, unjust, arbitrary, highhanded, motivated and discriminative and against statutory provisions, and consequently direct the respondents, particularly the 2nd and 3rd respondent, to prohibit the disbursement of voluntary retirement benefits to the 4th respondent, and pass…….” 2. Heard learned counsel for the petitioner, who appeared through virtual mode and learned counsel representing the learned Deputy Solicitor General of India. 3. Learned counsel for the petitioner with reference to the averments made in the affidavit filed in support of the writ petition, submits that the petitioner is the wife of the 4th respondent, challenged the action of the respondents in not disbursing the voluntary retirement benefits of the 4th respondent. He submits that the petitioner also filed civil suit in O.S.No.386 of 3 2015 on the file of Senior Civil Judge, Kadapa, arraying the official respondents as well as unofficial respondent No.4 herein, which was settled amicably between the parties in the Lokadalath on 02.05.2022. He also draws the attention of this Court to the proceedings vide NoJ.II.02/2023.Estt.IV(P/Cell) dated 26.08.2023 of the Deputy Inspector General of Police filed along with Memo dated 12.09.2023 by the respondents and submits that the terminal dues pending to the petitioner and her minor children had been disbursed by the respondents. Making the said submissions, he states that the cause in the writ petition does not survive. 4. On the other hand, learned counsel representing the learned Deputy Solicitor General of India, acceded to the submissions made by the learned counsel for the petitioner. 5. Having regard to the above submissions and in view of the proceedings vide J.II.02/2023.Estt.IV(P/Cell) dated 26.08.2023 of the Deputy Inspector General of Police, filed along with Memo by the respondents, the writ petition is disposed of. There shall be no order as to costs.
