JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 3 23-02-2026 Heard the learned counsel for the appellants as well as the informant and learned APP for the State. 2. This memo of appeal has been preferred against the order dated 18.09.2025 in A.B.P. No. 3268 of 2025 by which the learned Court of Shri Ajay Kumar Mall, Special Judge SC/ST (POA) Act, Muzaffarpur has rejected the anticipatory Patna High Court CR. APP (SJ) No.4413 of 2025(3) dt.23-02-2026 2/3 bail petition in connection with Katra P.S. Case No. 57 of 2025 instituted under Section 191(2)/ 191(3)/ 109/ 303/ 324(4)/ 126(2)/ 115(2)/ 351(2)/ 351(4) of the BNSS and Section 3(1)(r)/ 3(1)(s) of SC/ST Act. 3. As per the prosecution story, on 13.03.2025, all the FIR named accused persons along with 25-30 unknown persons allegedly intercepted the informant and his nephew at Bakhri Gatoli, assaulted them under the false pretext of being thieves. They also abused the informant and his nephew by calling their caste name, assaulted them and also snatched Rs. 10,000/- in cash from them. 4. Learned counsel for the appellants has submitted that the appellants are innocent and have falsely been implicated in the present case. Six persons have specifically been named in the FIR but the appellants are not amongst them. The informant, with ulterior motive, took the name of the appellants in his re- statement, but when he realized his mistake, he compromised the case. The appellants are persons of clean antecedent. 5. Learned counsel for the informant fairly submits that both the parties have amicably compromised the case. 6. Considering the above-mentioned facts and circumstance and the fact that both the parties have Patna High Court CR. APP (SJ) No.4413 of 2025(3) dt.23-02-2026 3/3 compromised the case, the appeal is allowed and the impugned order dated 18.09.2025 passed by the learned Court of Shri Ajay Kumar Mall, Special Judge SC/ST (POA) Act, Muzaffarpur in connection with Katra P.S. Case No. 57 of 2025, is set aside. 7. Accordingly, let the appellants, in the event of their arrest or surrender within four weeks before the learned court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Special Judge, SC/ST (POA) Act, Muzaffarpur in connection Katra P.S.
