Mr. Abdus Salam, Adv. …For the State As directed, the Kolkata Municipal Corporation has filed report which is as follows:- “As per order of D.G.(W/S), inspected Pr. No.188B, Diamond Harbour Road, owner Jaya Pal (Bag) and found that it is located at rear position which is shown in attached drawing demarked by red colour and other portion is behind portion of Sri Ashok Bar. Smt. Jaya Pal (Bag) wanted for the new KMC water connection at her premises which can be accessed through a passage width 1.20 Mt (aprox.) running straight from KMC maintained road where already service line is present. However the authenticity of the passage couldn’t be traced out as registered site plan is not available in the department. Also during physical inspection it reveals that Ashok Bag has got a separate KMC connection through the passage. A 2 schematic diagram showing the premises and the adjoining passage is annexed along with this report. The dept. has appraised the above matter to Addl. C.M.L.O. dt-22-04-2022…” In view of the observation of this Court in its order dated 10th January, 2025, and considering the report filed by the Kolkata Municipal Corporation today, the writ petition being WPA 21841 of 2019 is disposed of with the following directions:- 1. The Kolkata Municipal Corporation shall provide (new) water connection to the premises of the petitioner on submission of fresh application praying for the said water connection. 2. Considering the dispute between the petitioner and her brother who share a common passage, the local police station shall provide assistance to the officials of Kolkata Municipal Corporation while the said (new) water connection will be effected, on an application made by the officials for the same with the concerned police station. 3. The said water connection be effected within fifteen days from the date of the submission of the fresh application by the petitioner. Pending application(s), if any, stand also disposed of. 3 All parties shall act on the server copies of this order duly downloaded from the official website of this Court. Urgent Photostat certified copy of this order, if applied for, be given to the parties, on priority basis, upon compliance of all necessary formalities. There will be no order as to costs.
