2 Order on Board 03/09/2025 The office has pointed out the default that the counsel for the petitioner has erroneously classified the petition under Article 226 of the Constitution of India whereas it ought to have been filed as a WPC under Article 227 of the Constitution of India. 2. The default as pointed out by the office is overruled. 3. In the present petition, the petitioner has sought a limited relief for a direction to the learned Family Court (Link Court), Katghora, District Korba to decide the application for visitation of the child on his birthday falling on 4th September 2025 along with application for urgent hearing. 4. It is contended by the counsel for the petitioner that the petitioner has preferred an application under Section 7 & 10 of the Guardians and Wards Act which is pending before the Principal Judge, Family Court (Link Court) Katghora, District Korba. It is further submitted that the petitioner has moved an application before the concerned Family Court on 02.09.2025 for visiting her son on his birthday falling on 04.09.2025. He has relied upon the order passed by the Coordinate Bench in WPC No.2051/2025 dated 01.05.2025. 5. Shri Soumitra Kesarwani, PL assisting the Court, contended that the petition may be disposed of with a direction to the Family Court to hear the application filed by the petitioner tomorrow ie. 04.09.2025. 6.
Looking to the limited prayer of the petitioner and on perusal of the documents filed, the petition is disposed of with a direction to the Family Court, Katghora (Link Court) District Korba to make all possible endeavor to hear the application filed by the petitioner Ex.P-1 dated
