GP FOR REVENUE The Court made the following: 3 THE HONOURABLE SRI JUSTICE D.RAMESH WRIT PETITION No.32368 of 2025 ORDER: This Writ Petition is filed seeking to direct the respondents to change the classification of land from the Government Land to Private Land (Petitioners land) thereby mutating the names of Petitioners in respect of the land to an extent of Ac.0.73 cents and Ac.0.16 cents in Sy.Nos.198-1, 4 and 5 of Pydikonda Village, Thondangi Mandal, Kakinada District (herein after referred to as ‘subject land’) by updating all Revenue Records and issue e-Pass Books in favour of Petitioners and further direct the respondents not to interfere with the possession and enjoyment of the petitioners over the subject land. 2. Learned counsel for the petitioners submits that the petitioners are in possession and enjoyment of the subject land by raising cattle sheds without any interference from anybody from all these years. The subject land is totally private patta land and it is neither Government land nor poramboke nor communal lands. But, the land was claiming by the Government as if it is a Government property and staff of the revenue department have been trying to evict the petitioners from the subject land. The respondent officials are also proposing to lay plots of the subject land with an intention to issue pattas to the weaker sections of the Society. Hence, the petitioners made a representation, dated 20.09.2025 to the respondents, requesting to cancel the entries of the Government land in respect of subject survey numbers and 4 restore the names of the petitioners in respect of the same. The respondents having received the same has not considered the said representation. He further submits that on 03.11.2025 at about 11.00 am, the staff of the 4th respondent including surveyor along with the secretariat staff have entered into the subject land and tried to measure the same with an intention to divide the subject land into plots. Hence, the present Writ Petition is filed. 3. Learned Government Pleader on instructions has submitted that infact the subject land is classified as gunta poramboke and there is a road and 2 RCC buildings in the subject land. 4. On considering the submissions of both the learned counsels, as the petitioners have brought to the notice of the respondent authorities about their possession and title over the subject land, the respondents are directed not to interfere and dispossess the petitioners from the subject land without passing appropriate orders on the representation submitted by the petitioners, dated 20.09.2025. 5. With the above direction, this Writ Petition is disposed of. There shall be no order as to costs.
