GP FOR CIVIL SUPPLIES The Court made the following: 17 HON’BLE SRI JUSTICE NYAPATHY VIJAY W.P.No.22681, 26860, 26865, 27063, 27187, 28639, 28644, 28931 and 28934 of 2025 COMMON ORDER : As the issue is common in all the writ petitions, all the writ petitions are heard together and a common order is being passed. 2. The batch of writ petitions is filed declaring the action of Respondents in not sanctioning the differential amount of Gratuity by taking the calculation of the Daily Wage period, which is ratified by circular dated 10.07.2023, on par with other similar employees, who were retired and claimed their gratuity including daily wage period as illegal and arbitrary. 3. The Petitioners claim to have worked for Daily Wage period prior to their regularization in Respondent-Corporation. On 10.07.2023, a circular vide Circular 63 No.P.Admn/A3/336/2022 was issued by Respondent-Corporation, wherein it is stated that the issue with regard to payment of differential gratuity for daily wage period to the date of regularization of retired employees in the Corporation was considered in the 219th Board meeting on 23.03.2023 and resolved for payment of differential gratuity amount to the retired employees for the period from the date of joining on 18 daily wages to the date of their regularization of services as per the Gratuity Act, 1972. The retired employees are called upon to submit following documents while claiming for differential gratuity amount for daily wage period. 1. Copy of appointment order on daily wages in the Corporation. 2. Copy of regularization order of the retired employee. 3. Copy of Service Register from 1st page to 5th page. 4. Whether the gratuity amount was paid from the date of regularization to date of retirement/vol.retirement / expiry. If gratuity amount paid, indicate the amount paid and for no. of years of service. 5. Gratuity from claiming differential gratuity amount for the daily wages period duly signed by the retired employee to be enclosed. 6. Certification of “No Break in Service” during the relevant period by the concerned DCSMs/ZMs compulsory. 4. It is submitted by the Petitioners that they had submitted requisite documents on different dates, however, their cases are not being considered by the Respondent-Corporation. 5. Learned standing counsel for the Corporation submits that some of the representations along with required documents in terms of Circular No.63 were not received by the Respondent-Corporation. 19 6. Heard Sri K.Gani Reddy, learned counsel for the Petitioners and learned standing counsel for the Respondent-Corporation. 7. Considering the submissions made, writ petitions are disposed of with the following directions: (1) The Petitioners shall submit representation along with documents mentioned in the Circular No.63 within a period of eight (8)weeks from today. (2) On receipt of the representations, the Respondent- Corporation shall consider the same for payment of differential gratuity as per circular No.63 within a period of four (4) weeks thereafter.
