The present petition has been filed by the petitioners with the following prayer : “It is, therefore prayed that, the Honourable Court may kindly be pleased to set-aside/quash the impugned order dated 27.10.2018 (Annexure-P/1) passed by learned Second Additional Judge of Additional Sessions Judge Ramanujganj, District Balrampur-Ramanujganj in Criminal Revision No. R- 44/2018 (SHIV KUMAR YADAV & ANOTHER vs. SANJAY YADAV & OTHERS), in the interest of justice.” 3. Learned counsel for the petitioner No.01 states that the petitioner No.01 has died during the pendency of the present petition. 4. The present petition so far as it relates to petitioner No.01 is abated, as the petitioner No. 01 namely, Shiv Kumar Yadav, has died during the pendency of the present petition. So far as the petitioner No.02 is concerned, he is alive but none has appeared on behalf of petitioner No.02 nor any representation is made on behalf of him. 3 5. It appears that the petitioner No.02 has lost interest in pursuing the matter due to efÒux of time. 6. Accordingly, the present petition is dismissed on this ground alone.
