Petitioner has been made accused in connection with Chakradharpur P.S. Case No.48 of 2024 (S.T. Case No.355 of 2024), for the offence registered under Section 376 of the Indian Penal Code, pending in the Court of learned Additional Sessions Judge-III, Chaibasa. Petitioner on the pretext of marriage established consensual physical relationship with the prosecutrix, who is aged about 30 years. Later on, he refused to marry her. The petitioner is a married person. It is apparent that the petitioner has obtained consent for physical relationship by fraud. In view of the aforesaid facts, I am not inclined to release the petitioner, on bail. Accordingly, his prayer for bail stands rejected. (Ambuj Nath, J.) Jay/-
