ORAL ORDER This petition is filed by accused No.3 under Section 483 of Bharatiya Nagrika Suraksha Sanhita, 2023 praying to grant bail in Crime No.283/2025 of Byatarayanapura Police Station, registered for offences punishable under Sections 109(1), 126(2), 189(4), 190, 191(2), 189(2), 351(3), 352, 191(3) of Bharatiya Nyaya Sanhita, 2023.

learned counsel for petitioner and learned Additional State Public Prosecutor for respondent - State.

Learned counsel for petitioner would contend that, the name of the petitioner is not mentioned in the FIR and complaint. As per the voluntary statement of this

petitioner contained in the remand application, he has assaulted with a knife. But on what part of the body he has assaulted is not forthcoming. Accused Nos.1 and 6 have been granted bail by this Court and accused No.4 has been granted bail by the Sessions Court. The serious overtact is alleged against accused No.4 assaulting the injured with a knife on his neck. With these, he prayed to allow the petition. nick
4. Per contra, learned Additional State Public Prosecutor for respondent would contend that, the charge sheet has been filed. The wound certificate indicates that, all the three injuries sustained by the injured are simple in nature. The offence alleged against the petitioner is a heinous offence. With these, she prayed for dismissal of the petition.
5. Having heard the learned counsels appearing for parties, the Court has perused the FIR, complaint, remand application and other materials placed on record.

6. On perusal of the FIR filed by one Sri. Narayana A. who is a brother of injured - Sri Manjunath, a case came to be registered against accused Nos.1 and 2 and others in Crime No.283/2025 of Byatarayanapura Police Station, Bengaluru for the aforesaid offences. Except the names of accused Nos.1 and 2, the names of other accused names have not been stated in the complaint. On perusal of the said FIR, there is no overtact is alleged against this petitioner. On perusal of the remand application, the overtact is alleged against the petitioner is assaulting with a knife. The allegation of assault by knife on the injured - Manjunath is against accused Nos.4 and 7. The said averment has been made in the remand application based on the statement of injured person. The petitioner is in judicial custody since 29.08.2025 and as the charge sheet is filed, he is not required for further custodial interrogation.

7. Considering all the above aspects, the petitioner has made out a case for grant of bail with conditions. In the result, the following;
ORDER The Criminal Petition is allowed. The petitioner is granted bail in Crime No.283/2025 of Byatarayanapura Police Station, subject to following conditions: i) The petitioner shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with one surety for the like-sum to the satisfaction of the Jurisdictional Court. ii) The petitioner shall not tamper the prosecution witnesses either directly or indirectly. iii) The petitioner shall appear before the trial Court on all dates of hearing unless exempted by the Court and cooperate for speedy disposal of the case.

iv) The petitioner shall not involve in commission of any offence. If the petitioner found involved in commission of any offence, the prosecution is at liberty to seek cancellation of bail, granted to him. v) The petitioner shall mark his attendance in the jurisdictional Police Station on 2nd and 4th Sunday of every month for a period of six months.
