Heard the parties.
The petitioner has been made accused in connection with Deoghar Cyber P.S. Case No. 94 of 2024, for the offences registered under Section 79 of the B.N.S., 2023 and Sections 67, 67(A) of the I.T. Act and Section 14 of the POCSO Act, pending in the Court of learned Additional Sessions Judge-II, Deoghar. Petitioner is alleged to have made obscene photographs of the informant and her sister viral on the Instagram. Mr. Shailendra Kr. Tiwari, learned Spl.P.P. submitted that the petitioner was arrested in another case relating to cyber offence. It was further submitted that the mobile phone which was recovered from the possession of petitioner was used in making obscene photographs of the informant and her sister viral.
Learned counsel for the petitioner submitted that the petitioner has been granted bail in another case relating to cyber offence. It was further submitted that the SIM which was used in commission of the present offence, was not recovered from the possession of the petitioner.
In view of the aforesaid facts, I am not inclined to release the petitioner, on bail. Accordingly, his prayer for bail stands rejected at this stage.
