The Court made the following ORDER: I/ THE HONOURABLE SRI JUSTICE K SREENIVASA REDDY PETITION NO: 612 of 2025 RIMINAL QBPEBi The Criminal Petition, u/Sec.482 of the Bharatiya Nagarik suraksha sanhita, 2023, is filed On behalf of the petitioners/Al to A3 to grant anticipatory bail in connection w|Ith Cr.No.09/2025 of BhimuniPatnam Police Station, V-lsakhapatnam CommissiOnerate. 2. A case has been registered aga'InSt the Petitioners and Others for the offence punishable u/see.108 r/w 3(5) B.N.S. 3. Case Of the PrOSeCut'lOn 'ln brief iS that the deceased Botta srinivasarao was married to the informant Botta Varalakshmi and they have one daughter and one son. The-lr daughter Yam|lni was given in marr'lage with Al in the year 2020. But due tO some disputes between them, the said yamini used to stay w'lth her parents' house at Gollalapalem, BheemuniPatnam. Seven days Prior tO 25.12.2024, the deceased went to his parents' village Kaligiri. The deceased has been cont'InuOuSly th|lnking about the marriage life of his daughter and d'lsputes, for which he went in depression and committed su-lcide by hang'lng himself in h'ls brother's house at Kaligiri. On see'lng the Same, brother of the deceased informed the incident to the informant. 4. Heard. Perusedthe record. i__ `--i-Ts9 /,9 /I, /7 ¢,z< EHL= \ 5. Learned Assistant Public Prosecutor submits that investigation is at crucial stage and some more witnesses are to be examined. 6. A perusal of the material available on record goes to show that, father-in-law committed suicide on the ground that his daughter was being harassed by the petitioners herein. when the daughter of the deceased expresses with regard to harassment meted out to her, the deceased and his wife suggested her to adjust in the family. ln COnneCtiOn With that, the daughter of the deceased filed a police report in for the offence under Section 498-A IPC. Thereafter the daughter of the deceased was staying in the house of the deceased. In connection with that, the deceased was suffering for the reason that her daughter marriage life was spoiled. ln view of the same, on 25.12.2024, the deceased had taken extreme step of committing suicide. Thereafter on the next day, the present report was filed. 7. Even accepting the entire accusation to be true, there is any amount of ambiguity whether the offence under Section 108 B.N.S. would attract as against the petitioner herein or not. To attract an offence under Section 108 B.N.S. it js essential that all the ingredients of Section 45 of B.N.S. have to be satisfied that there shall be instigation or intentional aiding the person to commit suicide. There are no allegations whether the deceased was either instigated or intentionally aided to a\\ E= / I,Ey// ASSISTANT iE drive into commit suicide.+ on the ground that his daughter's marriage life has been spoiled, the deceased had committed suicide. In view of the same, this court is 'lnclined to consider the prayer of the petitioners/Al to A3 for grant of antiCiPatOry bail. 8. Accordingly, in the event Of their arrest With regard tO this Crime, petit'IOnerS/Al to A3 shall be released On bail On their executing a personal bond for a sum of Rs.10,000/-(Rupees ten thousand Only) each with two sureties for the like sum each to the satisfaction of the arresting police officials and also on condition that the Petitioners Shall make themselves available for 'lnvestigation as and when required and that they shall not cause any threat, -Inducement or promise to the prosecution witnesses. The petitioners shall appear before the Station House Officer concerned, once in a week i.e. on every Sunday between 10.00 a.m. and o5.00 p.m., till fil®lng of the Charge-Sheet. 9.
