(Oral) The present petition has been filed under Section 528, BNSS, for issuance of directions to official respondent Nos. 2 and 3, to take appropriate action against the private respondent no. 4 and to hand over the possession of the tractor as it illegally been kept standing in the police station without being involved in any case. Learned State counsel appearing on advance notice, on instructions from SI Sahil Singh, Police Station Ghanour, informs the Court that the said vehicle No. T0623HR2219AQ, Chassis No. T052559489DK, Engine No. E2556351. which was alleged to have been handed over to respondent No. 2-Satnam Singh, by the son of the petitioner, who is the owner of the vehicle, is now involved in other FIR No. 9 of 2025 under Section 323 and 41 IPC, registered at Police Station Ghanaur, Patiala, and is a case property in that FIR, therefore, cannot be released in favour of the petitioner as of now. He further submits that no application has been moved for release of the said vehicle on superdari.
