[2025:RJ-JP:46403] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Misc. 2nd Bail Application No. 15184/2025 Pankaj @ Jonny S/o Shri Guljarilal, Aged About 27 Years, R/o Bholji Ki Dhani, Tan Radhakishanpura, Police Station Udyog Nagar, Sikar, Tehsil And District Sikar. (At Present Confined In District Jail Sikar). ----Petitioner Versus State Of Rajasthan, Through PP ----Respondent For Petitioner(s) : Mr. Shiv Kumar For Respondent(s) : Mr. N.S. Dhakar, PP Mr. Tapesh Agarwal, PP HON'BLE MR. JUSTICE ANIL KUMAR UPMAN Order 18/11/2025 1. This second bail application has been filed under Section 483 of BNSS, on behalf of the petitioner, who has been arrested in connection with FIR No.361/2025 registered at Police Station Udhyog Nagar (Sikar), District Sikar for offence punishable under Section 8/21 of NDPS Act. 2. It is contended by learned counsel for the petitioner that the accused-petitioner has falsely been implicated in this case. It is submitted that first bail application of the petitioner was accepted by this Court while imposing condition on the petitioner that he will mark his presence in the concerned police station in first week of every month. It is submitted that due to unavoidable circumstances, petitioner could not mark presence in the first week of October, 2025. In these circumstances, the trial Court was [2025:RJ-JP:46403] (2 of 3) [CRLMB-15184/2025] informed by the concerned Police Station that the petitioner had not marked his presence, consequently, bail granted by this Court has been cancelled by learned trial Court. Counsel submits that in future, petitioner will abide and comply by the conditions imposed upon him by this Court. He submits that alleged recovered contraband was slightly above the small quantity. It is contended that there are no criminal antecedents against the petitioner of similar nature and trial will take considerable time in its conclusion. Counsel submits that after cancellation of bail by learned trial Court, the petitioner has been taken into custody on 30.10.2025 and further custody of the petitioner would not serve any fruitful purpose. 3. Learned State counsel opposes the submissions made by learned counsel for the petitioner. 4. I have considered the contentions. 5. Having regard to the totality of the facts and circumstances of the case; considering the arguments advanced by learned counsel for the petitioner, especially considering the fact that only on one occasion, petitioner failed to mark his presence in the concerned police station, but without commenting anything on the merits/demerits of the case, I deem it proper to allow the second bail application. 6. This second bail application is accordingly allowed and it is directed that accused-petitioner - Pankaj @ Jonny S/o Shri Guljarilal, shall be released on bail provided, he shall furnish a personal bond in the sum of Rs.50,000/- (Rupees Fifty Thousand Only) together with two sureties in the sum of Rs.25,000/- [2025:RJ-JP:46403] (3 of 3) [CRLMB-15184/2025] (Rupees Twenty Five Thousand Only) each to the satisfaction of the learned Trial Court with the stipulation that he shall appear before that Court and any court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so. 7. All the conditions imposed in S.B. Criminal Misc. Bail Application No. 9488/2025 shall remain intact. (ANIL KUMAR UPMAN),J CHARU SONI /143
