JUSTICE PRAMIL KUMAR MATHUR Order 17/11/2025 During the course of arguments, learned counsel for the petitioner has submitted that I.O. has not given notice under Section 35 of BNSS and if directions for compliance of Section 35 of BNSS is given then he wants to withdraw this bail application with liberty. The Investigating Officer is present in the Court has stated that after serving the notice to petitioner under Section 35 of BNSS, he will conduct the investigation in backdrop of dictum of the Hon’ble Supreme Court in the case of Arnesh Kumar Vs. State of Bihar & Anr., AIR 2014 SC 2756. Hence, the bail application is dismissed as withdrawn with directions to the I.O. concerned to conduct the investigation after due compliance of the dictum given in Arnesh Kumar (supra).
