...RESPONDENT(S): This Court made the following ORDER: This Writ Petition is filed under Article 226 of the Constitution of India by the Petitioners for the following relief:
“.. to issue a writ, order or direction more particularly one in the nature of mandamus declaring the action of the respondent no. 4 and 5 in not concluding the survey and fix the boundaries in respect of the lands of the petitioner being an extent of Ac. 0.18 cents out of Ac. 0.29 ½ cents out of AC. 3.54 in Sy. No. 531/3 and Ac. 0.12 cents out of Ac. 1.45 cents in Sy. No. 531/5 (Total Admisery Ac. 0.30 cents) respectively situated at Chilamathuru Panchayat Area and Mandal, Sri Satya Sai District pursuant to notice dt. 20.12.2024 is as illegal, arbitrary and violative of article 14, 21 and 300- A of the constitution of India and contrary to the provisions of the A.P. Survey and Boundaries Act, 1923 and consequently direct the respondent no. 4 and 5 to conclude the survey and fix the boundaries in respect of the above said subject survey number and pass…”
2. Heard the learned counsel for the petitioner and the learned Government Pleader for Revenue appearing for the respondents. 3.
The learned counsel for the petitioner submits that the petitioner is the absolute owner and possessor of the subject land admeasuring an extent of Ac.0.18 cents in Sy.No.531/3 and Ac.0.12 cents in Sy.No.531/5, out of a total extent of Ac.1.45 cents in Sy.No.531/5, situated within the

limits of Chilamathuru Panchayat Area and Mandal, Sri Satya Sai District. The petitioner acquired the subject land from her vendor by way of a registered sale deed dated 28.11.2024. Since then, the petitioner has been in peaceful possession and enjoyment of the subject property. Subsequently, the petitioner submitted a representation dated 09.12.2025 to the respondent authorities seeking to conduct a survey and fixation of boundaries in respect of the subject land. Pursuant to the said application, respondent Nos.4 and 5 issued a notice dated 20.12.2024 to the petitioner and the adjacent landowners stating that the survey would be conducted. However, instead of conducting the survey and fixing the boundaries, the authorities postponed the same without assigning any reasons. He further submits that the petitioner approached the respondent authorities several times requesting them to conclude the survey in terms of the notice dated 20.12.2024. However, the respondent authorities have not conducted the survey till date. Hence, the present Writ Petition. 4. The learned Government Pleader for the respondents submits that, as per the instructions received, the entire extent of land has already been converted into house sites and, therefore, it is not possible to conduct a survey or fixation of boundaries in respect of the subject property. ::4::

Having considered the submissions made by the learned counsel for the petitioner and the learned Assistant Government Pleader for Revenue appearing for the respondents, it appears that, pursuant to the petitioner’s application dated 09.12.2024 seeking to conduct a survey and fix boundaries in respect of the subject property, the respondent authorities issued a notice dated 20.12.2024 under the provisions of the Andhra Pradesh Survey and Boundaries Act, 1923, stating that the survey would be conducted. It is a statutory obligation on the part of the respondent authorities to either conduct the survey and fix the boundaries or pass appropriate orders or an endorsement pursuant to the petitioner’s application. 6. In view of the facts and circumstances stated above, this Court is of the considered view that the present Writ Petition can be disposed of by directing the respondent authorities to conduct a survey and fix the boundaries in respect of the subject property pursuant to the notice dated
20.12.2024. If, for any reason, the survey cannot be conducted, the respondents shall issue an appropriate endorsement indicating the reasons for the same, within a period of two (02) months from the date of receipt of a copy of this order. ::5::
