ORDER: The Criminal Petition has been filed under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’), seeking to enlarge the Petitioner/Accused No.6 on bail in Crime No.80 of 2025 of Gangireddipalli Police Station, YSR Kadapa District, registered against the Petitioner/Accused No.6 herein for the offences punishable under Section 103(1) read with 3(5) of the Bharatiya Nyaya Sanhita, 2023 (for brevity ‘the BNS’).
2. Heard the
learned counsel for the petitioner, the learned legal aid counsel for respondent No.2 and the learned Assistant Public Prosecutor. Perused the record. 3. As seen from the record, in this case. Accused Nos.1 to 4 were already enlarged on bail by the learned Trial Court vide order dated 17.09.2025 in Crl.M.P.No.1384 of 2025. Similarly, Accused No.7 was also enlarged on bail vide order dated 12.09.2025 in Crl.M.P.No.1383 of 2025 by the learned Trial Court. There are no specific overt acts attributed against the petitioner/Accused No.6. The petitioner was arrested on 04.09.2025. He has been in judicial custody for the past 83 days. There was a dispute regarding a particular piece of land between the accused and the deceased and his followers. Accused No.3 is the son of Accused No.6/petitioner. 3 Dr.YLR,J Crl.RNo.11342 of 2025 Dated 26.11.2025
4. The charge sheet reveals that while L.W.1 was walking on the road, L.W.6 came running towards her, shouting in panic. L.W.1 rushed to the main road and saw the deceased coming or a bike. Suddenly, Accused No.3 hit the deceased on the head. Accused No.2 cut his throat. Accused Nos.1 and 4 stabbed the deceased in his stomach and chest. Accused No.5 shouted to ‘kill the deceased and finish him’. L.W.1 screamed, cried, and tried to run towards them, but by then, all the accused had fled. L.W.1 went to the deceased and asked what had happened, but because his throat was cut, he was unable to speak and was struggling to breathe. It was mentioned in the charge sheet that Accused No.7 planned the entire murder. It was further mentioned that Accused No.7 provoked Accused Nos.3 and 6 to come and attack. However, Accused No.6 was not found at the scone of offence. 5. The learned Assistant Public Prosecutor submits that L.W.19 gave a statement that all the accused had conspired to commit the murder. L.W.7 is a direct witness. All the accused persons who directly attacked were enlarged on bail by the learned Trial Court, as mentioned supra. The petitioner is aged about 60 years and was neither present at the scene of offence nor did he provoke or participate in killing the deceased. The preliminary charge sheet has already been filed. The petitioner is a permanent resident of Naimela Village, V.N. Palle Mandal, YSR Kadapa District. He has got fixed abode.
If he is enlarged on bail with certain stringent conditions, he may not evade the process of law. \

6. gravity of allegations levelled against the Petitioner/Accused No.6, this Court is inclined to enlarge the Petitioner/Accused No.6 on bail. 7. In the result, the Criminal Petition is allowed with the following stringent conditions: i. The Petitioner/Accused No.6 shall be enlarged on bail subject to him executing bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties for the like sum each to the satisfaction of the learned Special Sessions Judge for Trial of Offences under SC & ST (POA) Cases Act-Cum- IV Additional District and Sessions Judge, Kadapa, YSR Kadapa District. ii. The Petitioner/Accused No.6 shall appear before the learned Trial Court on each and every adjournment without fail. iii. The Petitioner/Accused No.6 shall not leave the limits of the State of Andhra Pradesh without prior permission from the learned Trial Court. iv. The Petitioner/Accused No.6 shall not commit or indulge in commission of any offence in future. V. The Petitioner/Accused No.6 shall not, directly or indirectly, make any inducement, threat or promise to any
