The applicant has preferred this application under Section 438 of Cr.P.C. for grant of Anticipatory Bail, apprehending his arrest in connection with Crime No. 101/2025, registered at Police Station – Balrampur, District – Balrampur-Ramanujganj (C.G.) for the alleged commission of offence punishable under Section 61(2)(d) of BNS and Section 4,6 & 10 of the C.G. Agricultural Cattle Preservation Act, 2004 and Section 11(1) (Ä) of Prevention of Cruelty to Animals Act 1960. 2. As per the prosecution story the prosecution's case, that on dated 17.7.2025 on receiving secret information from an informer that a
2 pickup had crashed and was lying on the side of the main road in NH- 343 in Semarsot forest and it was alleged that the trolley was filled with cattels and cruelly stuffed and the driver of the vehicle had crashed the vehicle and fled from the spot. On this information, the vehicle and cattle were recovered and thereafter the Police has registered a case against the present applicant and other co accused. 3. The applicant is innocent and has been falsely implicated in the present case, as the allegations are false, baseless, and malicious. He has no criminal background, has not played any active role in the alleged offence, and had no knowledge of the same. The applicant has neither received any amount from the complainant nor is there any direct or reliable evidence on record against him. He is a respectable citizen and a permanent resident of the given address; hence, there is no possibility of absconding. In the event of arrest, his reputation and career would suffer irreparable loss, therefore he is entitled to enlarge on anticipatory bail. 4. On the other hand, learned State counsel opposes the submissions made by learned counsel for the applicant. He further submits that the present applicant has two criminal antecedents of the same nature in the years 2021 and 2023 and, as such, is a habitual offender.
Therefore, he is not entitled to the grant of anticipatory bail. 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the nature and gravity of the offence, the material available in the case diary, and the submissions of learned counsel for the parties, it is revealed that during night patrolling the police
3 recovered a crashed pickup vehicle in Semarsot forest containing cattle stuffed in a cruel manner, which were being transported illegally to Jharkhand. The applicant, along with co-accused, was involved in the offence, and he has two prior criminal antecedents of the same nature in 2021 and 2023, showing that he is a habitual offender. Therefore, this Court is not inclined to grant anticipatory bail to the applicant. 7. Accordingly, the anticipatory bail application of the applicant – Manauwar Ansari, filed under Section 438 of Cr.P.C. involved in Crime No. 101/2025, registered at Police Station – Balrampur, District– Balrampur-Ramanujganj (C.G.) for the alleged commission of offence punishable under Section 61(2)(d) of BNS and Section 4,6 & 10 of the C.G. Agricultural Cattle Preservation Act, 2004 and Section 11(1) (Ä) of Prevention of Cruelty to Animals Act 1960, is rejected. Sd/-
